The new design isn't supposed to resemble anyone, it's just a stereotypical 1980's musician. i thought it was because he died shortly after, but according to george in an interview, micheal’s (i think it was lawyers) came after them shortly after the game released.
The original Plants vs. Zombies had a "Dancing Zombie" which looked a lot like Michael Jackson. And the "Resemblance to Living or Dead" thing doesn't help much. Michael Jackson's family actually objected to it thinking it was a joke in bad taste.

I understand defamation but popcap is not a company who is trying to step on anyones toes and honestly chose MJ because of the thriller dance and not, as the OP said, because hes dead. The fact that he was alive when the game was made should be a clue.
