According to Rule 40 of the CCS (Leave) Rules, 1972, a Government servant who proceeds on Earned Leave or Commuted Leave is entitled to leave salary equal to the pay drawn immediately before proceeding on Earned Leave or Commuted Leave.
A Government servant on half pay leave or leave not due is entitled to leave salary equal to half the amount specified in sub-rule (1). A Government servant on commuted leave is entitled to leave salary equal to the amount admissible under (sub-rule (1).
These are statutory rules governing grant of leave applicable to all Government servants, except those who are governed by a separate set of rules, e.g. Railway employees, members of All India Services etc. The details of the exceptions are available at Rule(2) of these rules.
