Facts: The 1st respondent gave notice of dissolution of the firm to the appellants and filed a suit for dissolution of the partnership firm in the High Court of Judicature at Bombay. Initially, the constitutional validity of section 69 (2-a) of the Indian Partnership Act was not raised in the plaint.
