Sec. 406 IPC delineates the legal framework for addressing instances where individuals, entrusted with property or assets, breach the trust reposed in them by dishonestly misappropriating or using that property contrary to the terms of the trust.
Where the property has not been 'entrusted', section 406 IPC can have no application. For section 406 IPC it is essential that the property which is alleged to have been misappropriated was in fact 'entrusted' to the accused. In other words, 'entrustment' of the property in question is the sine qua non to make out an offence under section 406 IPC.
